The Terms and Conditions of ckeller.tennis aim to regulate the business relationship between you and us in a binding and fair manner. Therefore, the basis of an order and a contract are always the following General Terms and Conditions, the knowledge and inclusion of which you acknowledge and confirm by placing an order with ckeller.tennis.

Die Geschäftsbedingungen von ckeller.tennis haben das Ziel, die Geschäftsbeziehung zwischen Ihnen und uns verbindlich und fair zu regeln. Grundlage einer Bestellung und eines Vertrages sind daher immer die nachfolgenden Allgemeinen Geschäftsbedingungen, deren Kenntnisnahme und Einbeziehung Sie mit einer Bestellung bei ckeller.tennis anerkennen und bestätigen.

§1 Scope

1.1 The business relationship between ckeller.tennis and the orderer shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Any deviating terms and conditions of the orderer shall not be recognized by ckeller.tennis, unless ckeller.tennis has expressly agreed to their validity in writing.

1.2 Customer in the sense of these GTC are exclusively consumers.

1.3 According to § 13 BGB (German Civil Code), a consumer in the sense of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.

§1 Geltungsbereich

1.1 Für die Geschäftsbeziehung zwischen ckeller.tennis und dem Besteller gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbeziehungen in der jeweils zum Zeitpunkt der Bestellung gültigen Fassung. Abweichende Bedingungen des Bestellers erkennt ckeller.tennis nicht an, es sei denn, ckeller.tennis hätte ausdrücklich schriftlich ihrer Geltung zugestimmt.

1.2 Kunde im Sinne dieser AGB sind ausschließlich Verbraucher.

1.3 Verbraucher im Sinne dieser AGB ist entsprechend § 13 BGB jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können.

§2 Conclusion of contract

2.1 The product descriptions contained in the online store of ckeller.tennis do not constitute binding offers for the conclusion of a contract on the part of ckeller.tennis. They do, however, represent an invitation for the customer to submit a binding offer.

2.2 The customer can log in to his possibly existing customer account by pressing the “My Account” button and entering his access data (email address and password) in the fields provided. New customers can create a new account here by entering their email address in the appropriate field. After clicking on the button “Login” or “Register” the customer gets to his account, where an overview of the orders, the purchased photos can be downloaded, the address can be customized and especially the account details can be customized.

2.3 The customer can submit the offer via the online store ordering system of ckeller.tennis. The customer can select individual products under the menu item “Shop” and add them to the virtual shopping cart by clicking on the button “Add To Cart”. After clicking on “Cart”, the contents of the virtual shopping cart can be displayed in a separate window. The customer then has the choice of adding more products by clicking on the “Shop” button or proceeding to the ordering process by clicking on the “Proceed to Checkout” button.

To enter the ordering process, the customer is prompted to enter the billing address after pressing the “Proceed to Checkout” button. In addition, an overview of the products in the shopping cart is displayed. Before completing the order, the customer must agree to the “Terms and Conditions”, the “Right of Revocation” and the “Terms and Conditions” and agree to the provisions on the right of revocation.

2.4 ckeller.tennis may accept the offer of the customer within five (5) days by sending a confirmation letter to the customer (e.g. by e-mail) or by delivering the ordered goods to the customer; in the first case, the receipt of the declaration of acceptance shall be decisive, in the latter case, the receipt of the goods by the customer. If no acceptance is made by ckeller.tennis within the time limit, this shall be deemed as rejection of the offer. In this case, the customer is then no longer bound to his declaration of intent.

2.5 The period for acceptance of the offer begins on the day after the customer sends the offer and ends at the end of the fifth (5th) day following the sending of the offer.

2.6 The contract text is stored by ckeller.tennis and sent to the customer in text form (e.g. by e-mail) after sending his order including the GTC as well as the cancellation policy. In addition, the customer receives a message about this in the browser window after the order has been placed; this message contains the option to print out the order confirmation. Furthermore, the text of the contract is stored in the online store of ckeller.tennis and can be retrieved by the customer in his customer area at any time after entering his access data under the menu item “Orders”.

2.7 Only the German language is available for the conclusion of the contract.

§2 Vertragsschluss

2.1 Die im Onlineshop von ckeller.tennis enthaltenen Produktbeschreibungen stellen keine verbindlichen Angebote zum Vertragsschluss seitens von ckeller.tennis dar. Sie stellen hingegen eine Aufforderung zur Abgabe eines verbindlichen Angebots durch den Kunden dar.

2.2 Der Kunde kann durch Drücken des Button »My Account« sich in sein eventuell bestehendes Kundenkonto einloggen, indem er seine Zugangsdaten (E-Mail-Adresse und Passwort) in die dafür vorgesehenen Felder eingibt. Neukunden können hier einen neuen Account anlegen, indem sie ihre Email Adresse in das entsprechende Feld eingeben. Nach einem Klick auf den Button »Login« bzw. »Register« gelangt der Kunde zu seinem Account, in dem eine Übersicht der Bestellungen, die erworbenen Fotos runtergeladen werden können, die Andresse angepasst werden kann und insbesondere auch die Account Details angepasst werden können.

2.3 Der Kunde kann das Angebot über das Onlineshop-Bestellsystem von ckeller.tennis abgeben. Der Kunde kann unter dem Menüpunkt »Shop« einzelne Produkte auswählen und mittels Mausklick auf den Button »Add To Cart« dem virtuellen Warenkorb hinzufügen. Nach Klick auf »Cart« kann in einem gesonderten Fenster der Inhalt des virtuellen Warenkorbs angezeigt werden. Der Kunde hat dann die Wahl, durch Klick auf den Button »Shop« weitere Produkte hinzuzufügen oder durch Klick auf den Button »Proceed to Checkout« zum Bestellprozess zu gelangen.

Als Einstieg in den Bestellprozess wird der Kunde nach Drücken des Button »Proceed to Checkout« aufgefordert die Rechnungsadresse einzugeben. Außerdem wird eine Übersicht über die im Warenkorb befindlichen Produkte angezeigt. Der Kunde muss vor dem Abschluss der Bestellung zum einen den »Terms and Conditions«, dem »Right of Revocation« und den »Terms and Conditions« zustimmen und den Bestimmungen zum Widerrufsrecht zustimmen.

2.4 ckeller.tennis kann das Angebot des Kunden innerhalb von fünf (5) Tagen annehmen, indem er dem Kunden ein Bestätigungsschreiben übermittelt (z. B. per E-Mail) oder indem er dem Kunden die bestellte Ware liefert; im ersten Fall ist der Zugang der Annahmeerklärung maßgeblich, im letztgenannten der Zugang der Ware beim Kunden. Erfolgt innerhalb der Frist keine Annahme durch ckeller.tennis, dann gilt dies als Ablehnung des Angebots. Der Kunde ist in diesem Fall dann nicht mehr an seine Willenserklärung gebunden.

2.5 Die Frist zur Annahme des Angebots beginnt am Tag nach der Absendung des Angebots durch den Kunden und endet mit dem Ablauf des fünften (5.) Tages, der auf die Absendung des Angebots folgt.

2.6 Der Vertragstext wird von ckeller.tennis gespeichert und dem Kunden nach Absendung seiner Bestellung inklusive der AGB sowie der Widerrufsbelehrung in Textform (z. B. per E-Mail) zugeschickt. Zusätzlich erhält der Kunde nach erfolgter Bestellung eine Nachricht darüber im Browserfenster angezeigt; diese Nachricht enthält die Möglichkeit, die Bestellbestätigung auszudrucken. Darüber hinaus wird der Vertragstext im Onlineshop von ckeller.tennis gespeichert und kann vom Kunden in seinem Kundenbereich nach Eingabe seiner Zugangsdaten jederzeit unter dem Menüpunkt »Orders« abgerufen werden.

2.7 Für den Vertragsschluss steht ausschließlich die deutsche Sprache zur Verfügung.

§3 Revocation

§4 Prices / Terms of payment

4.1 The prices stated in the online store of ckeller.tennis are final prices. The prices therefore include in particular the statutory sales tax and, however, no shipping costs. However, since the purchased photos are sent by email, there are no shipping costs.

4.2 In the case of deliveries to countries outside the European Union, further costs may be incurred in individual cases for which ckeller.tennis is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in relation to the transfer of funds if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

4.3 The following payment options are available to the customer: Paypal.

4.4 If the payment method PayPal is selected, the payment will be processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, which can be viewed online at https://www.paypal.com/de/webapps/mpp/ua/useragreement- full in the case of an existing PayPal account or at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full, if the customer does not have a PayPal account.

§4 Preise/Zahlungsbedingungen

4.1 Bei den im Onlineshop von ckeller.tennis genannten Preisen handelt es sich um Endpreise. Die Preise enthalten also insbesondere die gesetzliche Umsatzsteuer und jedoch keine Versandkosten. Da die erworbenen Fotos per Email versendet werden, fallen jedoch keine Versandkosten an.

4.2 Bei Lieferungen in Länder außerhalb der Europäischen Union können im Einzelfall weitere Kosten anfallen, die ckeller.tennis nicht zu vertreten hat und die vom Kunden zu tragen sind. Hierzu zählen beispielsweise Kosten für die Geldübermittlung durch Kreditinstitute (z. B. Überweisungsgebühren, Wechselkursgebühren) oder einfuhrrechtliche Abgaben bzw. Steuern (z. B. Zölle). Solche Kosten können in Bezug auf die Geldübermittlung auch dann anfallen, wenn die Lieferung nicht in ein Land außerhalb der Europäischen Union erfolgt, der Kunde die Zahlung aber von einem Land außerhalb der Europäischen Union aus vornimmt.

4.3 Dem Kunden stehen die folgenden Zahlungsmöglichkeiten zur Verfügung: Paypal.

4.4 Bei Auswahl der Zahlungsart PayPal erfolgt die Zahlungsabwicklung über den Zahlungsdienstleister PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg, unter Geltung der PayPal-Nutzungsbedingungen, die im Falle eines bestehenden PayPal-Kontos online unter https://www.paypal.com/de/webapps/mpp/ua/useragreement- full eingesehen werden können oder unter https://www.paypal.com/de/webapps/mpp/ua/privacywax-full, sofern der Kunde über kein PayPal-Konto verfügt.

§5 Delivery/Contractual terms

5.1 Delivery of the goods will be made no later than within five (5) business days (Monday to Friday, holidays excluded) after the conclusion of the contract (in the case of PayPal).

5.2 The goods will be shipped to the email address provided by the customer in the ordering process, unless otherwise agreed in individual cases.

5.3 The risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer upon handover of the goods.

§5 Lieferung/Vertragsbedingungen

5.1 Die Lieferung der Waren erfolgt spätestens innerhalb von fünf (5) Arbeitstagen (Montag bis Freitag, Feiertage ausgenommen) nach Vertragsschluss (bei PayPal).

5.2 Der Versand der Waren erfolgt an die vom Kunden im Bestellprozess angegebene Email-Adresse, sofern im Einzelfall nichts anderes vereinbart ist.

5.3 Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der verkauften Ware geht mit Übergabe der Ware auf den Kunden über.

§6 Retention of title

If ckeller.tennis makes advance payments, it shall retain title to the delivered goods until the purchase price owed has been paid in full.

§6 Eigentumsvorbehalt

Tritt ckeller.tennis in Vorleistung, behält er sich bis zur vollständigen Bezahlung des geschuldeten Kaufpreises das Eigentum an der gelieferten Ware vor.

§7 Information on liability for defects

The statutory liability for defects shall apply.

Es gilt das gesetzliche Mängelhaftungsrecht.

§8 Information on online dispute resolution

The EU Commission provides an internet platform for online dispute resolution (so-called ODR platform). This ODR platform is intended to serve as a contact point for the out-of-court settlement of disputes in connection with contractual obligations arising from online purchase contracts. The ODR platform can be accessed at the following link: http://ec.europa.eu/consumers/odr. The e-mail address of the merchant can be found in the contact details or in the imprint.

§8 Informationen zur Online-Streitbeilegung

Die EU-Kommission stellt eine Internetplattform zur Online-Beilegung von Streitigkeiten (sogenannte OS-Plattform) bereit. Diese OS-Plattform soll als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten im Zusammenhang mit vertraglichen Verpflichtungen aus Online-Kaufverträgen dienen. §9 Applicable law

9.1 The law of the Federal Republic of Germany shall apply to all legal relations of ckeller.tennis with the customer, excluding the laws on the international purchase of movable goods. However, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the customer has his habitual residence.

9.2 Furthermore, this choice of law with regard to the statutory right of withdrawal shall not apply to customers who do not belong to a member state of the European Union at the time of conclusion of the contract and whose sole place of residence and delivery address are outside the European Union at the time of conclusion of the contract.

§9 Anwendbares Recht

9.1 Für sämtliche Rechtsbeziehungen von ckeller.tennis mit dem Kunden gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Gesetze über den internationalen Kauf beweglicher Waren. Allerdings gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Kunde seinen gewöhnlichen Aufenthalt hat, entzogen wird.

9.2 Ferner gilt diese Rechtswahl im Hinblick auf das gesetzliche Widerrufsrecht nicht bei Kunden, die zum Zeitpunkt des Vertragsschlusses keinem Mitgliedsstaat der Europäischen Union angehören und deren alleiniger Wohnsitz und Lieferadresse zum Zeitpunkt des Vertragsschlusses außerhalb der Europäischen Union liegen.
